Uninsured Driver, Accident, No Police Report?

got in an accident, he called the cops but all he asked us to do was exchange insurance information and left. This the problem, his vehicle registration is expired,he from out of state, no insurance, and there's no police report other than the pics I have. Do I have a case against him?
